VICTORY
David Walsh recently convinced the Supreme Court of Texas that the emergency medicine statute applied in obstetrical units without the patient first having to go to the emergency department. This resulted in a unanimous reversal of an adverse opinion from the Court of Appeals and reinstatement of a partial summary judgment in favor of an obstetrician and hospital.
ARBITRATION
VICTORY
Jeff Kershaw and Peyton Inge recently prevailed in an arbitration proceeding where a general contractor attempted to blame a subcontractor for causing the owner’s alleged damages. The arbitrator sided with the subcontractor and rejected the general contractor’s claim.
TRIAL
VICTORY
In March 2019, Peter Anderson successfully defended a cardiac electrophysiologist before a Dallas County jury in a case involving whether the electrophysiologist paralyzed a lung by injuring an important nerve during a cardiac procedure. After a week-long trial, the jury found in favor of the doctor.
